Pedestrian hit by car insurance claim

Have you been hit by a car? There are two possible situations in an accident between a pedestrian and a car:

Situation 1: The pedestrian violated the traffic rules

If the pedestrian is themselves at least partially to blame, it is legally considered to be their own fault. This will be the case if the pedestrian ignored a red light, walked in the middle of a busy road, or violated the traffic rules in any other way. Even if it is the pedestrian’s own fault, the car driver will nevertheless have to compensate 50% of the damage, and sometimes even more. This is the law. The car driver will normally have third-party insurance. We will therefore claim your damage directly from the other party’s liability insurer.

Situation 2: The pedestrian did not violate the traffic rules

In this situation, the car driver will naturally have to compensate 100% of the damages. Pedestrians are considered vulnerable traffic participants. This gives them extra legal protection. The sole exception to this rule is in the case of force majeure. This rarely occurs and is immaterial if the pedestrian is not at fault.
