Product liability

In product liability, the following parties can be sued by the victim:

  • The manufacturer of the product
  • The importer who brought the product into the European Community
  • The supplier if the manufacturer or importer cannot be identified

In practice, it often proves very difficult to find out the manufacturer of the product. The shop where you bought the product should tell you, but it often takes some persuasion.

Burden of proof

The victim does not have to prove the fault of the producer.

  • However, the victim must prove that he actually suffered damage and that this damage was caused by the product in question;
  • Furthermore, the claim must be brought within three years;
  • After three years, the legal claim for compensation for these damages expires.
