Holding horse owner liable
As a rider, you have extra legal protection. In case of personal injury caused by a horse, the owner of the horse (often the equestrian centre) is usually liable for the injuries caused by the horse. If you have fallen while horse riding, we can hold the riding school liable for the personal injury suffered. However, in the case of taking a riding lesson, you will almost always be attributed a certain percentage of own fault (because the court finds that you sat on the horse voluntarily). But you will almost always be compensated for most of your damages.
The general terms and conditions sometimes state that personal injury damages will not be compensated by the equestrian centre. There is no need to worry about this, because in most cases the liability does lie with the equestrian centre. Such conditions are not legally valid because it would unfairly disadvantage you and other visitors to the centre. You may have chosen to ride horses yourself, but that does not mean that the equestrian centre bears no responsibility. The owner of a horse can often be held liable for its behaviour.
Sometimes an equestrian centre also has horses stabled at it that do not belong to the centre. If you are injured by one of those horses, the liability lies with the owner of the horse or still with the riding school. You are then also entitled to compensation. Even if there is a sign at the riding centre with a notice such as ‘riding is at your own risk’, the riding centre can be held liable for personal injury.
